Terms & Conditions, Delivery & Returns

Welcome to CHLOË GALLERY.

Each painting and print is an artwork made to be lived with, cared for and enjoyed. I want your experience of becoming a custodian of a piece of my work to be as considered and straightforward as possible.

These terms explain how orders are placed, how your artwork will be delivered and what to do if you change your mind or something isn’t quite right.

1. About CHLOË GALLERY

CHLOË GALLERY is the online gallery of artist Chloë Tinsley.

Business address: CHLOË Gallery Studio, Restronguet Barton Farm, Mylor Bridge, TR11 5SP.  This is a private studio and is not open to the public.  Visits are strictly by appointment.

2. Artwork and editions

The gallery offers original paintings, prints and, where available, artist-finished editions.

Original paintings are individual works. Prints and editions are produced from the original artwork and are described individually on their respective product pages.

Each product listing provides information about the artwork, including its size, materials, edition details where applicable and price.

As artwork is presented digitally, colours may vary slightly between screens and the physical artwork.

Any such variation will not affect your statutory rights if an item is materially different from its description.

3. Prices and payment

All prices are displayed in pounds sterling (£) unless otherwise stated.

Prices include any applicable taxes.

Payment is taken at checkout using the payment methods made available on the website.

The total price, including any applicable delivery charges, will be displayed before you complete your order.

Any optional personalisation or additional services will be clearly described and priced before purchase.

4. Placing an order

When you place an order, you will receive an email confirming receipt of your order.

Your order will be accepted in accordance with the terms of the purchase and the applicable consumer protection requirements.

Please check your delivery address and order details carefully before completing your purchase.

If you notice an error, please contact me as soon as possible.

I will do my best to help if an order has not yet been prepared or dispatched.

5. Delivery

UK delivery

Delivery charges for unframed drawings and prints are displayed at checkout and are payable in addition to the artwork price unless a promotional offer states otherwise.

Unframed drawings and prints are sent by Royal Mail Special Delivery within the UK unless otherwise clearly stated.

Original paintings are sent from my Cornish studio to your home using a specialist Cornish art logistics firm wherever possible.

The delivery arrangements and any applicable charges for an original painting will be explained on the relevant product page or agreed with you before purchase.

Any promotional free-delivery offer will be clearly described, including the products and destinations to which it applies.

International delivery

International checkout is not currently available for all products.

If you are ordering from outside the UK, please contact me before placing an order so that I can confirm whether delivery is available and provide a postage quotation.

International postage is not included in the advertised price unless otherwise stated.

Any applicable customs duties, import taxes or other charges imposed by the destination country are the responsibility of the recipient unless stated otherwise.

International delivery arrangements, including any applicable charges, will be agreed before the order is placed.

Packaging and dispatch

Artwork is carefully packaged for its journey.

Unframed drawings and prints are prepared for dispatch using appropriate protective packaging and sent by Royal Mail Special Delivery within the UK, unless otherwise clearly stated.

Original paintings are carefully prepared and, where possible, transported from my Cornish studio by a specialist Cornish art logistics firm.

Dispatch times and estimated delivery periods will be stated on the relevant product page or communicated with your order confirmation.

If an artwork is delayed, I will keep you informed.

6. Your right to cancel

For most online purchases of physical artwork, UK consumers have a statutory right to cancel their order within 14 days of receiving the goods, without giving a reason.

You then have a further 14 days to return the goods after notifying me of your decision to cancel.

Please include your name, order number and the artwork you wish to return.

You may use the cancellation form at the end of this policy, although this is not compulsory.

Returning an artwork

If you cancel an order under your statutory cancellation rights, you are responsible for the direct cost of returning the artwork, provided you were informed of this before purchase.

Please take reasonable care when handling and repackaging the artwork.  

If an item has been handled beyond what is necessary to establish its nature, characteristics and functioning, a deduction may be made for any resulting loss in value where permitted by law.

Please retain proof of postage.

For original paintings, please contact me before arranging a return so that we can agree a suitable and secure method of transport.

Refunds

Where you exercise your statutory right to cancel, I will refund the amount paid for the artwork and the cost of the least expensive standard delivery option offered.

If you selected a more expensive delivery option, the additional delivery cost will not be refunded.

Refunds will be made within the legally required timeframe, using the original payment method unless otherwise agreed.

Where permitted by law, I may withhold a refund until the artwork has been returned or evidence of its return has been provided.

7. Personalised and custom-made artwork

Some prints may be available with an individual dedication or other agreed personalisation.

Where an artwork is genuinely personalised or custom-made to your specifications, it may be excluded from the statutory right to cancel.

If an item is excluded from cancellation rights, this will be clearly explained on its product page before purchase.

Personalisation does not affect your statutory rights in relation to faulty, damaged or misdescribed goods.

If you are considering a personalised print and would like to discuss the inscription, please get in touch before placing your order.

8. Damaged, faulty or incorrect artwork

I take care to package artwork securely and to ensure that orders are correct before dispatch.

If your artwork arrives damaged, faulty or different from what you ordered, please contact me as soon as reasonably possible at:

Please include your order number and photographs of any damage where possible.

I will work with you to resolve the issue in accordance with your statutory rights.

Depending on the circumstances, you may be entitled to a repair, replacement, refund or other appropriate remedy.

Nothing in this policy limits your statutory rights.

9. Original paintings

Original paintings are individual works and may have specific delivery, packaging or collection arrangements.

For moving paintings from my Cornish studio to your home, I use a specialist Cornish art logistics firm wherever possible.

The delivery arrangements, estimated timescales and any applicable charges will be explained on the relevant product page or agreed with you before purchase.

Where an original painting is purchased online, the usual statutory cancellation rights apply unless a specific legal exception applies.

If you are considering an original painting and would like to discuss delivery, viewing or collection arrangements, please contact me.

10. International orders

Customers ordering from outside the UK should contact me before placing an order so that I can confirm whether delivery is available and provide an accurate postage quotation.

International postage is not included in the advertised price unless otherwise stated.

Import duties, customs charges and local taxes may apply and are the responsibility of the recipient unless otherwise stated.

International consumers may also have rights under the laws of their country of residence. Nothing in these terms is intended to remove any mandatory consumer rights that apply to your purchase.
